Track Packs like the one you mention are easy to add because they are retail products on disc that don't require any other game to play. Grand Theft Auto IV expansion is also easy because it has a retail package with a voucher inside of a box. Song 3 packs however are just minor additions, no different than the dozens of cars in Forza 2 or the planes of Ace Combat 6.
I guess the general rule of thumb is, whatever a PC packs together in a package as an expansion, is a safe addition for downloadable content on a console. If there's enough content to nearly be it's own game it goes into the database. Everything else is just microtransactions.
